YellMe Terms of Use

These Terms of Use (the “Terms”) set out the conditions for using the iOS app “YellMe” (the “App”) provided by MyAppLab (“we”, “us”). By signing in to the App, you are deemed to have agreed to these Terms and the Privacy Policy.

1. Application

These Terms apply to all relationships between us and you regarding your use of the App. Any individual rules or notices that we separately post within the App also form part of these Terms.

2. Accounts

  1. To use the App, you must sign in with Sign in with Apple or Google Sign-In.
  2. You are responsible for appropriately managing your account and authentication credentials.
  3. Any action taken through your account is deemed to be your own action.

3. Fees and Subscription (Premium)

  1. Certain features of the App (Premium) are offered as a monthly auto-renewing subscription.
  2. Billing is processed through Apple In-App Purchase (StoreKit) and charged to your Apple ID.
  3. Unless canceled at least 24 hours before the end of the current period, the subscription renews automatically and the renewal fee is charged.
  4. You can cancel from “Settings > Apple ID > Subscriptions” on your device.
  5. Fees, refunds, and renewals are governed by Apple’s policies and the App Store terms. As a rule, we cannot provide individual refunds.
  6. On the free plan, some features are limited and ads are displayed (Section 4).

4. Advertising

On the free plan, ads are displayed through Google AdMob. For how ads and data are handled, please see the Privacy Policy. No ads are shown on the Premium plan.

5. AI Features

  1. The App’s “AI cheer” feature generates feedback such as encouragement, empathy, and advice using AI, based on the diary and other content you enter.
  2. AI cheer is reference information intended to support self-journaling only, and is not a substitute for medical, psychological, legal, or other professional advice. For matters involving your health or safety, please consult a professional.
  3. We do not warrant the accuracy, usefulness, or appropriateness of AI-generated content.

6. User Content

  1. Rights to the diaries, records, and other content you enter into the App (“User Content”) belong to you.
  2. We use User Content to the extent necessary to provide, maintain, and improve the App and to generate AI cheer. We do not use User Content to train generative AI models.
  3. Details of how User Content is handled are governed by the Privacy Policy.

7. Prohibited Conduct

In using the App, you must not:

  1. Violate laws or public order and morals;
  2. Infringe the rights or interests of us or any third party;
  3. Interfere with the operation of the App or gain unauthorized access;
  4. Reverse-engineer, modify, or redistribute the App;
  5. Engage in any other conduct that we reasonably deem inappropriate.

8. Intellectual Property

Intellectual property rights in the App and related trademarks, logos, programs, designs, and content (excluding User Content) belong to us or the rightful holders.

9. Disclaimer

  1. We do not warrant that the App is fit for a particular purpose, is accurate, complete, or useful, or that it will be provided continuously and without interruption.
  2. Except where we have acted with intent or gross negligence, we are not liable for any damages arising from your use of or inability to use the App.
  3. Notwithstanding the preceding paragraph, even where we are liable, the scope of compensation is limited to the amount you paid to us (or Apple) in connection with the App during the most recent 12 months.

10. Changes, Suspension, and Termination of the Service

We may change the content of, suspend, or terminate the provision of the App without prior notice to you. We are liable for any resulting damages only to the extent set out in the preceding section.

11. Account Deletion and Cancellation

  1. You may delete your account at any time from “My Page” in the App. Deletion completely removes your user data on the server and on your device (for details, see the Privacy Policy).
  2. If you violate these Terms, we may suspend or delete your account without prior notice.

12. Governing Law and Jurisdiction

These Terms are construed in accordance with the laws of Japan. In the event of a dispute between us and you regarding the App or these Terms, the Japanese court having jurisdiction over our location shall be the exclusive agreed court of first instance.

13. Changes to These Terms

We may change these Terms as necessary. If we make material changes, we will announce them in the App or on this page. If you continue to use the App after a change, you are deemed to have agreed to the revised Terms.
